Terms of Service

1. Service Description

Psyop360 is a browser-based AI video production platform. The Platform provides tools for AI video generation (lip-synced talking-head videos), voice synthesis and cloning, timeline-based video editing, and related media production features. We leverage third-party AI models and APIs to power rendering and voice generation capabilities.

2. Accounts

You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Notify us immediately of any unauthorized use of your account
• Not share your account with others or create multiple accounts to circumvent limits

3. Credits & Billing

The Platform operates on a credit-based system. Credits are consumed when you use rendering, voice synthesis, and other compute-intensive features.

• New accounts receive a one-time allotment of free credits.
• Additional credits may be purchased through the Platform via Stripe.
• Credits are non-transferable and have no cash value.
• Used credits are non-refundable. Refunds for unused credit balances may be considered on a case-by-case basis at our sole discretion.
• We reserve the right to change credit pricing and consumption rates at any time with reasonable notice.

4. Bring Your Own Key (BYOK)

The Platform supports a BYOK mode that allows you to connect your own API keys for supported third-party services (e.g., ElevenLabs, fal.ai). When using BYOK mode:

• You are solely responsible for any costs incurred through your own API keys.
• We store your API keys in encrypted form and use them only to make API calls on your behalf.
• You are responsible for complying with the terms of service of the respective API providers.
• We are not liable for charges, rate limits, or service disruptions from your third-party API providers.

5. Acceptable Use

You agree not to use the Platform to:

• Create deepfakes intended for fraud, harassment, defamation, or impersonation of real individuals without their consent
• Generate child sexual abuse material (CSAM) or any content sexualizing minors
• Produce content that violates any applicable law or regulation
• Generate content designed to spread disinformation that could cause real-world harm
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, exploit, or compromise the Platform's infrastructure

We reserve the right to suspend or terminate accounts that violate these policies, without refund, at our sole discretion.

6. Content Ownership

You retain ownership of the content you create using the Platform, including generated videos, audio, and images. You grant Psyop360 a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the service. We do not claim any ownership rights over your generated content and will not use it for training, marketing, or any other purpose without your explicit permission.

7. Platform Intellectual Property

The Platform — including its software, interface design, branding, documentation, and all underlying technology — is the intellectual property of Psyop360. Nothing in these Terms grants you any right, title, or interest in the Platform itself. You may not copy, modify, distribute, sell, or lease any part of our software or services.

8. Third-Party Services

The Platform integrates with third-party services to deliver its functionality. By using the Platform, you acknowledge and agree that you are also bound by the terms of service and privacy policies of these providers:

• fal.ai — AI model inference and video rendering
• ElevenLabs — Voice synthesis and cloning
• Fish Audio — Text-to-speech generation
• Stripe — Payment processing

We are not responsible for the availability, accuracy, or conduct of any third-party service.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that AI-generated outputs will be accurate, complete, or free from artifacts. AI models are probabilistic by nature and results may vary. We make no guarantees regarding uptime, rendering speed, or the continued availability of any specific AI model or feature.

10. Limitation of Liability

To the maximum extent permitted by law, Psyop360 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. Our total aggregate liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. We may, but are not obligated to, retain your data for a reasonable period following termination. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership, disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
